Hi, i am a british citizen and wants to divorce my husband who is nepalese citizen. we have been married for 30 years and we have a daughter and a son of 28 and 25 years. they dont live with us, I live with my husband here in nepal but my husband has been cheating on me and i have enough evidence to prove it. i have asked my husband to give me 50% of his assets but he is refusing it. i just wanted to know that despite being a foreign citizen, do i have any chance to file for divorce and fight to get 50%?

it would be very helpful if you could help me out here.

Please consult a Nepalese lawyer. What I am saying below is in generality.

First, you won't get 50% because you have a son and a daughter too. Basically, your son will get 50% and the rest 50% is divided between you and and your husband. So you get a share of 25% in totality. Also. keep in mind that there might be a new law where daughter also gets parents property. If that is the case, your total share will even go down.

Consult with a lawyer please.
Also, Nepal does not allow a foreign national to own any property. So not sure how you are going to get the property in your name.

Divorce, you can get it, that should not be an issue.

Hello Sonia, as a woman myself, I advise you to not beg for 50%. You should have built your own asset. May be what you can do is cheat back on your husband with a young guy or something.

Advice pani kasto hau? Husband cheated on me so I would cheat on him!!! LOL! What if the wife is NOT immoral like the Husband? What if the wife wants to be dedicated to the husband or a single man! It is a matter of personal choice, correct?

@soniat: Definitely consult with a lawyer. I am sure as a wife you deserve half of the assets without doubt. Do get opinions from various law firm tho.

@samitabaral: She is not begging, that belongs to her as well. And when your married you both are involved to make the property whether you stay home and take care of kids or work. There is no saving just for yourself. At this point of life there is no way to come up with money you would need to move on. Hell you would fight for that property and it is the right thing to do!!

my 2 cents,, pardon me if i am wrong. as far as i know nowadays children in nepal implicitly don't have rights to their parents properties like in the past but spouse do. so, legally you have right to obtain 50% of what your husband owns but you must go through lawyer in nepal.
