Hello mitraharu, I am traveling to Nepal this dashain/tihar after 14 years and wanted to get ya'lls experience within the last year or so on traveling on AP. I came on a F1 visa and then stopped going to school which jeopardized my status for about 3+ years until TPS was granted. I am currently working as a contractor in IT and will be taking the following papers during my travel: 1) TPS approval notice (2016 and 2017); I didn't apply for TPS again since its auto renewed 2) AP document with expiration date of March 2020 3) Federal Notice print 4) Valid Drivers license with March 2020 exp date 5) Letter from my employer that states I still work for them 6) Nepali passport I have already booked my tickets. I have never been convicted of felony or misdemeanor either..clean record so far.
I was wondering if there are similar individuals here who fell out of status like me for a few years and were able to get back into the US without any issue? The AP document has a disclaimer that says getting back to the US is not guaranteed and advises consultation with a lawyer before traveling. Please share your recent experiences (since Trump took office) in similar matter and also let me know if I need to take any additional documents?

Wait till the court hearing , out of status harulai re entry nadeko case haru dherai cha tps ma , don’t take chances if you had committed crimes or was out of status dhs will not let you in , unless you have a I-130 pending you will not be let in , not to be taken chances now .

i highly doubt your reentry is possible, though im not in america ( i moved nepal after 9 years stay ), my wifes friend husband was entry denied, he was out of status for 4 years but he also had a record of driving without license, he was not engaged in any accident but was ramdom pullover , he was driving wife car for grocery, since he had no status so had no licenses. he was confidend koz his wife applying citizen after some time. to be on safe side i would recommend you to be mentally well prepared, since chances are u might not return, so what would you do in that case . like selling your property , cars , making sure your credit cardds are good shape , n also dnt put money in ur account . this is six month old story, what i know is they asked his all social media account so make sure u dnt criticise any political learder in social media. as i said i am not familar with this AP thing works, i was never out of status but take precaution, if possible try avoiding travel. or get a canada or mexico visa entry and exit from there

I have seen few people who were out of status for lots of years and now on TPS successfully coming back on AP. @internationalkhiladi: pending i-130 has nothing to do with someone traveling on AP and nobody traveling on AP will be asked at POE about pending i130.

baikuntha ji.. no need to worry. Have a safe trip and come back safely. I have seen people who came in visitor visa and overstayed the visa for 10 or more years and were still able to return back with TPS AP. Make sure you return with plenty of time before the march 20. 2020

I went india last year with pending asylum and came back to USA without any hassles with TPS advance parole. Please not that TPS is a status so there will not be any issue if you travel through AP. At POE, officer will take you in a secondary room for parole stamp and you have to wait around 10-15 minutes depending upon busy. Good luck and safe flight to Nepal. Happy Vijaya Dashaimi and Deepawali.

You have no problem going back and forth WITH VALID AP, EVEN YOU ARE OUT-OF-STATUS FOR 20 YEARS.
BUT AS ON YOUR COMMENT " ( Since Trump took office)" WHICH IS A YOUR political view towards US current administration can haunt you.
So keep out of politics on social media.

No doubt, AP is not a guaranteed entry just like B1,B2,F1,F2 and so many other non immigrant statuses. However, I don't find a reason to freak out no matter what, unless the tyranny in the white house demands DHS for some stricter policies on Parolees flying abroad. The meaning of the word ' Parole ' should make it obvious, that you are released for a time being with a promise of return if you want to. I'm a parolee myself going to Nepal on an AP for Dashain for 45 days and I'm only 90% positive about reentry. If denied, life doesn't END there!.....I have a question though...Will staying out of US for more than 45 days be a problem??????

Don’t worry folks. I personally got Got an investigation for fraud ... and DHS officer came to my home for search. I have my pending asylum but due to TPS status they didn’t do anything. Later I went India and came back to USA without any hassles so guys relax and don’t be panic. I’m damn sure traveling with AP won’t stop at POE in USA while returning back.
