Hello All,
I am in the process of filling out visa application to US embassy. On that form it says have you ever applied for any immigration benefits to US. My mother’s elder sister has filled a family petition for my mom and I am on that I130 as well. Do I have to mention that on my visa application process? Please advise if anyone has any insights.

a4apple,Applying for student visa after already applying for immigration is a display of serious conflict of purpose. The student visa will be denied right away by the counselors, as this visa is of non-immigration intent. If you lie and do not reveal in the application about the petition, you may or may not face some repercussions later at the adjustment of status, I do not know for sure. If your sister has filed the petition way earlier and the priority date is soon approaching, then maybe it is advisable to wait until the issuance of immigration visa in Nepal itself, and not apply for the student visa as of now.

Dont hurry up and come to usa to suffer. Having undergrad in the USA doesnt give u any competitive advantage over foreign degree holders. I dobt know what ur interest is , But If i were u i would go to India for studies 1st. Study IT or any science subjects. Try to get internship and join coaching in the evenings and learn python, sql , c# ,java as much as u can in ur own pace. In few years u will be job ready and have papers too. No body cares if u have a degree from usa or not , not even if u have a degree or not in most tech jobs. If u hurry up and come to usa , unless u have a very good scholarships, u will suffer a living hell and actually can be a drawback to start ur career. Seriously , people who cone from India or even Nepal after degree completion have much better chances and advantages to do well in careers.

If you mention about I130, Probably you won't get the non immigration visa if your immigration visa is under process. If you lied and they find it then you know what happen...

a4apple: I agree with Benedict and echho2, if you fill in I130 and mention your sister's name in their then it they can see everything in their. The way echho2 mentioned to do bachelor in india is also a great idea, I myself being a bachelor student here I can feel how things are and how tough it is. I think the best would be to have a patience and wait for the petition, again even if you apply for I130 it is totally doable however can be little challenging or risky. Also, as tutepani mentioned lying can cause a lot of hassle ani immigration ma chai straight NO nai ho kina ki in long run it can be a huge issue ; Having said you can apply for student visa BUT try to be patient and may be adopt the sponsorship route MAYBE.

Thank you all for your inputs. Btw the petition is not under my name, it’s under my moms name and I am part of the application and by the time i130 is approved I will be over 21 and will disqualify. Would that still affect me now when applying for a F1 and do I have to mention that on the visa application ?

unfortunately F1 is a single intent visa just for study .come study and go back.if it was categorized as dual intent visa (intention of staying here as well like H1b) it would not be problemn.try H1b instead of F1

a4apple,It is a complicated scenario and I do not want to be held responsible for any untoward happenings. The best bet would have been only sponsoring your mom for now and excluding you, but if your name has already been given in the I-130 petition, then for counselors, it means, you are intending to immigrate in future and hoping to procure immigration benefits. Technically, it may take lot of time until you reach the priority date after the approval and all those steps, (by the time which you may even complete your studies and you may cross your 21) but interview counselors will not look into that. They do not worry about how much time it may take, or whether you will be eligible for that particular immigration benefits or not. All they will care while making decision about your student visa application is that whether you have previously applied for any immigration petition or not. Technically if the counselors see that you have applied for immigration benefits in the application, there is straight "No" from them if they go by book, but sometimes, the counselors "may" think differently, as each one of them is a different person. You may get the visa and get through but when it comes to the adjustment of status day at the end of your immigration petition, again, they will ask you all the details about how you entered USA and all and when they see the date you applied for I-130 and then the visa you came with, they "can" say you took advantage of student visa (non-immigration intent) to come here and immigrate. This might end up not so well then.
I wonder if anybody here in Sajha can ask the immigration lawyers regarding this matter. a4apple, I do not want to recommend you any ideas, it is going to be your call now. I am explaining the scenarios as they look out to me, but yes sometimes they may not play out the way we keep imagining, exceptions do exist everywhere. I request you to read more related articles on the internet.

I do not understand why Sanaklaal is after my posts every time I write something. See buddy, I want people like a4apple to come and study in USA. I support people who have the zeal and grit to prove their mettle in the foreign land. I want to see fellow Nepalese to prosper and succeed here. Look at the Indians, where they have reached now. No doubt, they have the brains to make it big in this land, but also because they help one another out, unlike you who is always busy pulling people down.
