BetterNepal, thanks , you mean even though USCIS revoke H1B, can we transfer H1B? I mean within 30 days USCIS will revoke H1B. do they consder transfering H1B within 30 days from the lay off? please enlighten me on this, I am really confused wheter to join college or look for job. Please whoever been through this situation share your experiece or suggest me, will really appreciate your inputs. poonamchand

Here is an excerpt from some forums: "The INS has typically been taking several months to process H1B revocation notices, which means that, as a practical matter, the revocation of the H1B petition may not appear in the INS system for several months."src; http://www.murthy.com/news/UDtermh1.html So in worst case, even if your employer sent a revocation application to USCIS, there should not be a problem in transferring h1B. I am quiet not sure about how long can we stay without payroll in h1B. I have heard lot of stories like, we cant be in h1b withour payroll (not even a single day), also heard that there has been a successful h1b transfer without payroll for 2 months etc etc. I welcome other experts to speak in this case..... good luck

I m not an expert but as per my knowledge; Did your company send H1B termination request to INS , Check this with you company and for which month ? In your friends circle look for consultancy company and transfer your H1 and do not show your weakness to the consultancy company ( i mean any talk like that ) talk with confidence and start looking for job ? If I were you then I would look for job i would not go back to F1 status as you do have experience and look for full time job again. Post your resume in monster.com and dice and look for job in craglist. Are you a Java Developer ? or ? Good Luck.

Thanks M$Hacks, and BetterNepal I am not IT professional though. I am in accounting. So it is ok to join indian consultancy? Thanks for your input guys,it helped me somehow. Hi Poonam, I was also on H1B and got laid off last week. So here is what I know, you are out of status the day you got laid off but there is a 10 days grace period inwhich you have to find other job or change status to F1/F2. I did mine to F2. Once you change to F1/F2, then if you find a job within one year, you still need to apply for H1 but do not have go through lottory and wait until october as you are already selected. You will just apply for H1B and as soon as it is approved ( which does not take that long), you can work. I did not join consultancy because I heard bad things about it and since you can apply for job even if you are in F2 and do not have to go through lottory.

Thanks Gazabakomanche,naya ghare thuldai and pahadekaancha, I consulted my lawyer and he told me that I have like 30 days to find job and then I can transfer my H1B. He even said sometime USCIS consider 2 months to transfer H1B. So it's really a confusing . So please experts like Santosh giri, tthapa, and any one who gone through same situation, input your thoughs so that I can take best decision. I will really appreciate. thanks F2 ...not right now

Mero H1b chha. Got my BBA in Finance .Went for Business Analyst training and have not gotten a job yet. Aba thinking to go back to school for masters in Accounting. As per the thread discussion, Even after transitioning from H1b to F1, if you get a job in the course of study time, you can work under H1B.But, my understanding is that , employers will need to file for h1b petetion and one dont need to go through all the lottery hassle. I am sick of being on bench, I rather earn a new degree in the meantime, will be busy with school and at the same time get a more rewarding degree. i.e Accounting. Any suggestons.. Thanks in Advance..

Read this is the phrase
"When a person is in on H1B visa, he/she should be working for the US employer and getting paid according to the terms on the Labor Condition Application. There is no such thing as a grace period or bench time without pay. The employer has to pay the H1B employee whether or not the person has a "project."
Anybody, if you have the link or thread could you post where you found there is "10 days" grace period is available. As per terms, assumed that there is no grace period on H1, the last day of pay chex is the date of validity. Thanks
