i am an undergraduate student in US. someone filed a case against me for unauthorized employment. So i am now kept in deportation process. I haven't been given a court date yet. I am graduating on may 2010 and don't want to return back before that. I want at least to graduate. I am trying to consult with the lawyers. Can anyone tell me what should i do in this case. what are the other option available for me to stay in the US or stay at least till my graduation. Any immigration lawyers reading this ,plz help me...

ya... you can get help from a laywer.... i ve heard that u wont get deported if u were caught for the first time on an appeal that u were unknown about that law..... or... u ll ve to stay illegal in diff. state...

Hi bideskochoro1, whom do you suspect filing a case against you and how do you come to know that you are in process of deportation although you havent given a courtdate yet? I also heard that you wont be deported for first time caught illegally.Dont know much abt that.

the homeland guys caught me and told someone had complained and they caught me. that's how i know that. They have started the process. I talked to some people but nobody told me that i won't get deported. People have told me as by law, i will certainly get deported sooner or later. I hope it is as you guys are telling that i may not be deported for my first offense. I am really tensed and worried. I don't wanna lose all my money, time and investment at this point of time when i am at the edge of graduation. so, guys please help me and tell me what should i do. and thanx for ur replies raxi and ss727

bideskochoro1, i have made inquiry abt your case with my frns my frn here says that the homeland security persons should inform abt your illegal work to your international advisor and warn you for the next time. But testo case hamro college ko student ma bhako chaina tehi bhayera idea teti chaina, texas ko eauta college ko kta le mexico gayera reinter garnu pareko theo bhannea suneko chu.

bideskochoro, sorry to hear that.Hope everything will be fine. I dont know that they can directly take you to airport and send you home. i believe that they will file some charge on you. But remember bro what ever they ask you remain quite tell your layer to answer all those shit. you just say "FOR EDUCATION" dont give other reason if they ask you why you work in gasstation? Transfer your money to nepal. Incase they are sure to deport you they wont give chance to take your money out from bank. I heard they will seize all your property if they deport you.this might not be true. its just my thought. i was never in that situation. but i know some one got deported back in 2005. But his case was stealing money from work place unlike working like you. sorry if i scared you. hey did those guys show you their identification? And did they handed you some ticket? here also, one of my friend has same situation two guys came and they told they are from homeland bla bla bla and u are working illigeally bla bla but at last they said they are foking around. i dont know about your case. hope someone with similar situation will guide you in safe direction. stay cool.

No I didn't use my ssn. They were the real homeland guys. and as u told sulab they filed a case against me. Some of the friends in some posts above told that i should have been given a warning for the first time, i am surprised why that didn't happen with me. whatever happens with my case,either i win or lose, i want to stay here at least till my graduation. I believe there might be some legal loopholes to just keep on extending the case for about a year or any other option. all the friends and legal advisors reading this please suggest me.

hey dude, there is a 50-50 chance of being deported, or not if you get a good lawyer, there is a chance of staying here and even a chance of getting work permit Do the following things - Call all your credit cards issuers and tell them to send you balance transfer checks, and write those checks to yourself leaving 100- 200 dollars in the card
- Transfer all your checking / saving account money to your friend's or relative who is legally working in United States
- Apply for more credit cards and do the balance transfer
- Apply for canadian tourist visa, its easy and cheap
if you do these things, this will help a lot if you get deported and the best way to handle the case is a good lawyer, don't try to get a nepali lawyer coz he is cheap, try to get a white one or at least indian. GOOD LUCK

Hey crazieddie, thankx for ur advise. Are saying to transfer credit balance to my checking and then to my relatives coz they seize my money and bank balance if i get deported ? well should i do that now or when i go to court and when it seems i am losing the case. well as u told it would be the safest idea to not to keep money with myself. But dude can i apply for tourist visa at this point. and moreover they have taken my passport and will give back whenever the court gives the decision. Thankx for ur suggestion

Bideskochoro1, i think you should get hold of lawyer immediately. I don't think its a wise thing to get comments from people in sajha. You need a good advice from a lawyer so that you can make a right decision at this point.

bideshkochoro1, so sorry to hear this. hopefully everything will be okay. since you already said homeland guys came and you already got caught you are in a critical situation please try to understand the situation and consult with the lawyer immediately without any delay. making google search, asking in threads and online forums would help a little but wont help much to save you from your current situation cause you already got caught from homeland people. so dont wait for them to take action on you try to act before that. Even though they might just give you warning and nothing happens to you but still consult a lawyer right away. you'll end up paying 250-500 lawyers fee or may be more but still it is worthy . Durga bhurtel (nepali Lawyer) @ 212 947 1079 (not Recommended) you can also get lawyer info from www.murthy.com If you dont like any of the above lawyers type immigration help in google you'll find many other options to get hold of lawyer.

As there is 50/50 chance, think what is more important? To graduate (anywhere in the world) or to stay in the U.S(anyhow). Donot panic. This is only my view point, you might think difffrent than I do. All the best.
