Hey! I am sure I am not the only one facing this issue. Lawyer says, choose consular processing, its impossible from here.. Right now I am in the US in F-1 status. I was selected for the diversity lottery program for 2009 and now as published in the Visa Bulletin, my case number falls in the range to be current in April. I haven't received any written information from any concerning body about further processing. I entered US in 2006 and I haven't left the country from then. I did unauthorized employment for about 2 years. I don't work at present and I have valid I-20 and visa still at present. Now that, I am planning to adjust status, and I know my employment is a ground for my ineligibility. So, 1) Is there any way I can get a waiver? 2) If I went back to my home country to be interviewed, will my unauthorized employment not be a problem at all? Does the immigration law differ for processing within US and processing from abroad? 3) If consular processing back in Nepal is the only way, How risky step it would be?And if things didn't went right, will I still be able to re-enter to US in my existing student visa?

Therez no doubt about my selection .. I alredy got first letter. Just meant to say that I didnt get furthur notification after sending back my first letter. I contacted Kentucky and found it was jst a simple address mistake, and there I found that the letter is not important at all, still they have sent it to my new address, and I should get it within2-3 days. My case is already current in April. All I need to do now is go to Immigration office and fill out I-485 along with other forms. Tara sathi kaam garepachi ekdum problem hune rahecha.... I dont see any hope at all... Still I m optimistic that I will find someone who have gone thru this situation before...n give me some ideas...

Silugadi, I was also selected for DV2007; according to visa bulletin, my number fell in December. So, I filed I-485, travel, and work authorizartion altogether. I got my work authorization card on February, and my interview for the Greencard was on august 15th. So, it is a lenghty process. By the time they reach your number, I think its gonna be late, it ends at September 30th. If you do consular processing, it is much more faster, and I dont think they can pull up your employment history. Think about the consular processing, you dont wanna miss this chance.

mine also falls current in April.........but i worked in OPT period only the interview date is on 17 June. My friend also got DV and she got it through the adjustment of status...........she also work here using SSN but only during OPT period.............I am going Nepal for interview
