I was curious how this works and well i thought i would try sajha.com and get some opinions from my fellow nepali bruthas and sistaz. I have been out of status, meaning stayed alot longer than my visa allowed and was planning to go to the UK. I was just curious as to whether the british consulate will give me problems because of my status here in the States. If anybody has experience and more knowledge in this matter plz do share. Any help is appreciated.

I don't think there is any collusion between US and British embassy to share the out of status information however, they may have made provisions for this after the 911 attack. You do, however, need to answer whether you have overstayed in other countries while filling out the visa form for UK where you definitely will have to lie and also you will have to lie about not going to USA as they will definitely check that information with American authorities to verify that you have not committed any crime. Otherwise there is no way you are going to get the visa. My mate from Hungary did the same more than ten years back and came here but I don't know how things are these days because of the advance in IT. Also, your pp will have landing information on it when going back to Nepal and you will have to sort that out too. Its difficult but not impossible if you have no bad intentions.

Hey man thanks for the advice. Well to tell you the truth i was thinking to apply for a british visa directly from here in the States and fly directly to the UK. I think going back to Nepal first might cause more of a problem but either way i think it will be a problem to explain everything if they do look into everything. Anyhow thanks for the advice and if any other people have more suggestions please let me know. thanks.

Well, to apply from US I think you have very little chance of getting a visa. Because since you are applying from the third country (not Nepal or UK), you must show strong tie (emotional, financial etc) with the US and prove them that you will return to US after the completion of your visa. I don't know if you have that document to show your financial tie with US. I also don't know wheter they can see your status from your passport.

One of the docs u need to present to the UK embassy is of your legal status in the US (visa/I-20 etc). In your case it'd be best to apply from Nepal.
