I come to Nepal and did my H1B stmping from Nepal. My H1 B visa approved on October 2008. I got H1 B visa stampped on April 2009. The problem is I am out of project. I came Nepal on February 2009. I was out of project on December 2008. My dhoti consultancy employer ask me to stay in Nepal till they get me new project and told me I can't come US without project and US immrigation officer will return me from US port if I come there. Since I am here in Nepal, I didn't get any call from vendor/client. and everything seems not practicaland I feel i can't get US job from Nepal. i can't visit US in time if client wants face to face interview.If I come US without informing my employer, it is a risk. any suggestions ideas will be highly appreciated. thanks.

One guy just came yesterday with his wife. He was on the same boat. I hope you don't have to worry about it. The DHOTI Consultany can't offer you a job, thats why they are telling such a story. Good luck.

KarmaYogi,
Once a Person is in H1b he has to be paid all the time..So if you r not in the Project it's better to stay in Nepal till things become little bit better..I understand ur situation but don't take a risk of coming to US..Yes , these days there is a great possibilty that one may be returned from port of Entry..

I dont think there should be any problem since your employer is Dhoti Consultancy. How immigration can know that you are in project or not? There is no way to know that and the documents describes itself that you are employed to the Dhoti Consultancy and By Law, if you are in US, they should keep paying you the salary. There is no bench period law in US. So get all the documents and come to US. You might also want to bring the vaccation letter or something like leave letter that u might have while getting back to Nepal. So my suggestion is that there should not be any problem. You can also get free consultation from immigration lawers in USA. Good Luck

Thanks all of you. If I came US and in port of entry if immrigation officer ask me abt my project what should I answer them.if they verify i will be caught at the spot.

Hi, I had same situation like urs. My project got over on Dec 2008 and left for Nepal on Jan, 2009 planning to come back on end of Feb. So before i came back, i called my employer to make sure everything is ok. But they told me to stay in Nepal and start marketing. I said ok and didn't say any single words. But i knew that, there is no way we can get project staying in Nepal. That too we used to have 16 hrs power outage. So withing saying any single word to my employer and returned back to US. But i did one biggest mistake informing my employer that i am back. I shouldn't have done that as they have sent me an termination letter with in week. But fortunately, i transfer to another employer and thanks to God, it got approved. To be frank, i didn't have job at that time.
