Hello Everyone, I have a question regarding H1B Transfer. Suppose an individual is being sponsored for H1B from company "A"(for the first time,.. before that individual was in F1 status) and his application is send to USCIS. The process is pending and still not approved by USCIS. Before having the conformation of H1B, he wants to switch to another company "B". Is it possible to switch the employer in between the H1B filing process i.e before H1B being approved. Any information on this would be greatly appreciated.
Thanks, tuktuk

H-1B Transfer applies to an approved H classification. In your case, the H petition is still pending. Since the Transfer and an initial filing both costs the same, why not file an initial petition from B during this quota, opening April 1st? In an alternative, you could have B process it under premium. Good Luck.
