I just checked my status online on USCIS webpage and just found that my OPT request has been denied. I am yet to receive the letter. What are my options now ? How much time do I have ? I can't guess any obvious reason now. Any help will be appreciated. Thanks in advance guys.

Thanks Furke for your reply. I have no idea why it was denied. I will know it, once I get the letter, which I am still waiting.

Thanks.

The only options I can think of are: get a new I-20 within 60 days from the day you graduated(graduate) or find a company that would sponsor your H-1 visa. There still are lots of H1 visas available so as long as you find a company to sponsor you, u can start working.

When did u graduate or When do you graduate? Did u use 1 year of full-time CPT ? Did you use any pre-completion OPT?

Thanks sab_nepaliko_sathi. I graduated in August 21 this year. I did little more than 10 months of CPT and no pre-completion OPT. I thought, everything was ok. I can't come up with any reason right now.

How does the 60 days count ? Does it start from the day I completed my Master's ?

Thanks

For most people, the 60 days start from the completion date on their I-20. If you graduated earlier than the I-20 date, the 60 days start from the date of completion of your program of study.

Besides the 12 months full-time CPT and pre-completion OPT I can't think of any reason your OPT would be denied. I have heard of a guy whose OPT extension was denied because the school put the wrong CIP code. It could be a similar clerical error that got your request rejected. Please post the reason once you get the letter. It will be helpful to all.

Try contacting a GMAT/GRE institute ( like Kaplan ).

Also, you might wanna wait for a while as you might've been denied due to an error in filing.

Join kaplan until december then you can transfer to NOVA community college. They will accept your application easily. Then in fall you can go back to graduate school. But it's tough. Since you already have masters, I would rather advise you to go back to Nepal. America is a mess broda. If I had a masters I would have flown to Nepal the next day of my Graduation. We can create opportunity in Nepal. Nepal needs lots of skilled people, especially in the field of politics. We have to supplant banarasi netaharu and help the country aspire.

Thanks Guys,

Joining Kaplan is a good idea. I might do that to be here little while and make a decision on what to do further. Going back to Nepal is also not a bad idea.

I got the Letter from USCIS. The reason they say is "Applicant is engaged in CPT for more than aggregate 12 months".

The problem here is they counted my part time CPT also as full time CPT. I am going to apply for "Motions to Reopen or Reconsider".

I did work in CPT for around 2 years. But only 313 days as Full time. I should be able to make my case here.

What do you think about it ?

Unfortunately, the letter doesn't say anything on how I can reopen the case or Appeal against it. My international student advisor is also not sure about this. This guy is new and hasn't encountered such situation before ( This is good opportunity for him to learn ). He suggested me to talk to attorney. I am going to do that.

Do anybody know good immigration lawyer in Bay Area ?

Thanks all.
