Help please!!
5 years agadi F1 visa ma gas station ma kam garda minor lai tobacco beke ko case cha. ahile ayera I-485 adjustment of status ma interview ma bolako cha next month. RFE ma case ko expunge/dispose gareko letter mageko thiya tara court le time ma diyena. Ahile chai court le deko cha so tyo liyera interview ma jadai chu. Not much worried on this part.

What i am worried is that fact that tero status ke thiyo tyati bela, kina F1 visa ma kam gareko and all those question haru sodcha ki soddaina hola. i am hoping officer will only look for the expunged letter as requested in RFE and don't ask for the status and other question. Tyas bela ko status sodhyo bhani ke bhanni hola eso help gar dinu hola. Kam chai cash ma gareko ho tax tireko chaina.
Maile chai eso uncle ko store ma volunteer garda pareko ho bhanne bichar gareko chu.Please share experience.

Whatever you say, make sure you can back it.
If you say, it was your uncle's and you were volunteering, you must be able to provide that information if they ask for proof that it was your uncle's.
Maybe better to say something like it was your friend's and you were watching it for him while he had to go out for a while or similar...
Remember, anything you say, they can hang on it and ask for more info.

I usually don't look at immigration thread, but since I look into this, I think your situation is little screwed, so get to good attorney right away. Usually your Ilegal employment gets reset once reenter country, so if you have been out of usa, and came back again recently, then ur unauthorized work days is already reset, if not the. You have accumulated unauthorized employment which uscis overlooks for 180 days. But you have also lied in application saying you didn't work, but they have court record that you worked.

If your unauthorized unemplyment has been reset they are just looking for court documents and on other side they have ground of false info in application. You might just get away with saying I was not actually working but it depends on officer to believe you and burden of proof is on you.

Not trying to scare but, hookup with good layer, maybe saying you worked for month cause you didn't know and quit after after knowing about these court hassle is best middle path. That is less then 180 days of unauthorized work, and should be fine. But again check with lawyer, I haven't been following immigration recently, things might have been changed.

how old were you when you were arrested for this crime ?
was this charge a misdemeanor and you were convicted with it.

what you need to find out is if this conviction can be reason for denial of eligibility. go to USICS and find out. most likely this crime will fall under moral aptitude. but find it if this does really fall in it. if yes, you need to lawyer up.

since this is a employment based green card, ia m sure you have a lawyer. if not, you need to get one. you don't want to fuck up this over 2 grand of saving.

lying to USCIS may jeopardize your situation. When you say something, always think about another counter question and how would you prove that.

Whats with re-entry and resetting unauthorized employment. Video game ho ki k ho ?

In a way it is a complicated scenario, unauthorized employment is a serious business . If it's been more than five years, You might be excused. You should have replied to the RFE with court documents, you should have gone to the court and got it. You had enough time. It shouldn't have gone to an interview stage.

Whats done is done. Get hold of an immigration lawyer, call them first , they charge you by hour, talk to them and tell them honestly everything. You can go from there.

If you are on a STEM field and have not been out of status ever, chances are high you will be ok. Wasn't there a diversion program for a first offense ? Any other criminal charges etc will play a role.

This is reason I don't usually replay to immitration threads. I know it's not video game, though I play a lot. For your info google something called 245k, you will see what I am talking about if you understand or fellow law. But again I am not layer, and i recommend original poster to consult with lawyer.

Thank You all for replying. The case seems to be much more complicated than i thought it was. I am getting hold of immigration lawyer. I will keep you posted.
