Just curious if anyone can accept the promotion after he/she receives the EAD card (Form 1765) but I485 still pending. Anyone?

Promotion is internal to the company and nothing to do with the USCIS. The only thing is salary should not be less than specified in PWD. Go for it and Congrates.

I was ready for the promotion before my labor certification was approved. However, during that time, my lawyer told me it is not a good idea to take a promotion until I receive my green card..Tesaile ahile aba paauchha ki paunna bhanera ho...but since you suggested, I might go talk to my boss that I am legally in a postion to accept the promotion...Thanks Bro...

You should be in the position which your perm was advertised for at the time of 485 approval.

Don't give wrong suggestions. So u think Indians who have to wait 5-6 years to apply for i485 stay at the same position and same salary for those many years!!!!!

You can definitely be promoted provided you wil be doing similar type of work at a higher position. It can't be like from a software engineer to a Sales Manager.

@ny2 that's what is happening to my Indian colleagues waiting for green card with 140 approval. They're stuck in same position for many years more than 5 yrs . I am also in your position waiting for GC and my corporate legal said the same thing.

Let me try to explain little more , The concept is they did labor certification on that position and it got passed because no us citizen or pr holder applied, and based on that labor your 140 gets approved and thus 485. Now if you move your job or your job role is different then what's the purpose of your labor. The new role you got when your 485 got approved was never labor tested. So it might differ for company to company and how they put job description on your promoted position , and why a company will have two positions for example engineer , Sr engineer with same job role and responsibilities, you can talk to your lawyer also . if you thing it's wrong suggestion then it's fine.

The reason its happening to those indians are because their boss/employers want to take advantage of the waiting time by not increasing their salary or position. That doesn't happen in big companies.

USCIS allows you to change the company after 6 months of i485 application, we r taking about a promotion in the same company with similar but more responsibilities.

Yo I-485 application file gare pachi kati din ma approval hunchha? approval bhayeko Nepali haru le share gardinu hola.
