since 2020 employment based has been faster, around 4 months for the adjustment whereas it take around 4 months to a year for marriage based . associated risk is much higher in employment based , job market it down n will likely worsen until 2024 . so marriage based for safety .

my opt expired, joined for masters this semester, so no opt until master is done!! Currently in TPS which is valid until 2023 June, and My company said they will start green card processing from August 2023 provided I don’t get laid off since lots of tech jobs are laying off employees!!

On the other hand my girlfriend is agreeing to help me get green card via marriage based, so wondering which way would be better and faster,  in dilemma

Employment based green card is taking much longer than pre covid times. The PERM step alone takes 18 months to 2 years right now and DOL is not showing any signs of improving the processing times. After PERM the i140 and i485 takes around 6 to 12 months depending on your luck. The overall process takes 3 years from start to finish. Talks of recession is making companies layoff thousands of employees and its gonna get worse so I think marriage based petition is best at this moment and a safer option too.

Marriage based greencard could be potentially be faster but employment based greencard can also take longer.

Dude, she would not think that you are getting married for Greencard; just love her unconditionally true love, keep her happy afterall you guys will be a team after marriage.

All the very best.
