I work in a start up company and they dont know how to do the process for H1. They wanted me to find out what documents you need and what are the requirements. What do I need to apply for the H1 visa. Plus I graduate this semester with my MBA. I am just taking one more class this semester. Do I fall into the masters quota and will I need a document to show that.

Brother,
Do you hold your MBA degree on hand or you're taking one class this Spring semester and will officially graduate in May this year?? To be able to apply for H1B you need to have your official degree/diploma in hand. If you are taking one more class this semester and will officially graduate or receive your degree in May, I am sorry that you would not be able to apply this April for H1B. However, if you hold an official MBA degree already, you can surely apply for it.
You can also either apply for H1B next April when you'll be in OPT or aply for H1B with your Bachelors degree in hand. For more information, consult an immigration attorney.

HappyFace is wrong.
Get a letter from ur college dean that you are graduating this may and yaa INS will ask for official transcript within 60 days from your case approval.
Check with lawyer, this is how it used to be done previously but u never know when would these immigration rules changes.

Last year, some of my frens had applied in the way cincinati boy is saying, their H1B was rejected. They are now OPT and applying this year again. Better to consult the attorney.

i am also in same situtation, i am regesterining only 3 credit research hours for this spring and i will be graduationg in this may with M.S degree.i already got a job and my company will sponser H1 for me. Do i fall into masters quota or not? any suggestion?

Thanks for all the replies but I am still confused about the letter. Do i just write a letter stating I will be graduating in May 11 08 or do I need to write a letter stating I have finished the requirement. I am taking one class this semester and it is a requirement which will be done in may 8 2008.
And even if i do that will they approve that or not. Or do they need the diploma. If I dont get it this year then I have to apply next year under masters quota. However my opt will expire on may 12th 09. then I will probably join the same school i am in right now with different area of interest. So on that period between may 12th to oct 1, if i get approved ca i still work say under CPT.
Let me know. Also can an employer apply for GC right away without even filing for H1.
I dont know shit about immigration. Any help will be highly appreciated.
