 Question: Can we leave US after applying for H1B Visa.

I am starting this thread to get ride of some of question running into my mind about going back to my home (Nepal) first week of May, 2008.
 
My employer is going to do my H1B visa processing in April, 2008. So in such case can I travel to my country after starting the H1 visa process? Some of my friends said that I cannot leave USA after applying for H1 visa. So I want to know form you all what is the case.

Do the premium proceesing, get ur status within 15 days, after that u r free to go anywhere u like ..but remember u can only come back to  the USA 10 days before  October 1st. Correct me if I'm wrong..

not a big deal.  after you are done with H1B paper work, you can leave.  ask your employer to send the approval notice to your address back home.  then, apply for visa and come here not before 10 days of october first.

I am not planning to return in October ... I am planing to return after a month of travel to Nepal. So is there any complication while returning i.e around May ko last week, 2008.

my understanding is, with your H1b visa, you can not enter USA 10 days before october 1st.  so the answer  is NO if you want to return after a month of your stay in Nepal.  you better take some summer classes here and go to nepal at the end of august if you want to do so and come back after a month.

I have a valid student visa till Feb 2009 and now i am in CPT which ends in 15 April,2008 but i will get another 1 year of CPT which last for 15April,2009 and i will graduate in June,2009 so can i travel back home.

If i didn't or did get H1B visa i still have valid CPT and F1 visa...so???

well i am not an expert on these issues.  i am writing these based on my knowledge.  your visa does not matter much.  important thing is, whether you have completed your education in usa or not.  if you have completed your education, then even with valid visa you can not enter usa.  looks like you have not since you are talking about CPT.  you are allowed to work under CPT.  it will be a good idea if you can use CPT during summer starting from period you come back from Nepal.  since you are F1 student with valid visa, you wont have problem coming back with same visa.  however, if you change your status to H1, your f1 will be automatically terminated.  you can not have two status at the same time, that is H1 and F1.

I am doing some distance course so i am still in F1 + i am working in CPT.... i will still have some course remaining after i return US.

Can we avoid summer classes with I-20 for fall semester in hand within the grace period ? My opt is ending on mid of May. But I'm not sure will the university issue I-20 within July or not. Hey, sthapit brother,can u plz forward me yr distance learning university and the process of getting CPT in the first semester?

University: Maharishi University of Management
doing Masters in Computer science

Did  8 months of on campus course after which we are allowed to do 2 year of CPT or 1 year CPT and 1 Year OPT....

I was in same situation as you in 2006. I had made all the documents ready to apply for H1 by April. I was planning to submit the application and go to Nepal in May. The lawyer came to know about it and recommended me to submit H1 application as soon as i came back in May. Luckily I was back few days before the quota ended and I had make the copy of new I-94 and send it to the lawyer. I would recommend you the same, because when you leave US you will have to give the current I-94 at the airport. And by the time your H1 will be processed, that I-94 may be not in the system.

Acc to u we r not allowed to leave US after applying for H1B and untill its approved??? Due to I-94 change and all that u had mentioned.... hoena ta....
