Hi all,

My employer is going to file H1B for me in Master's quota on April 1.I am married and have a child;both of them accompanying me here in the US.Is is necessary to submit any document regaring spouse/children,while applying for H1B?My employer says it is not required,but is enough if it is mentioned that I have spouse/children accompanying me.Any information regarding this would greatly be appreciated.

You MUST file for your spouse and child also to change status from F2 to H4.

My understanding is also the same.However,he what he says is the document of the Spouse and son can be collected after filing your H1.Is that true?

I believe when you file your H1B application, you should also include your spouse's and child's applications so that their status can be changed to H4 as well.  If they were outside of the US, then yes, their applications could be filed later.  Since they are in the US with you, their applications need to be filed with yours.

I am not in legal profession, so be sure to verify what I said above.  You could probably google immigration related sites for better perspective.

You need to talk with lawyer and provide all docs of your spouse and child including copies of passport, I-94 and I-20s. You also need to mention in you r H1 application that  you are applying for adjustments of status. I dontb know why your lawyer is not willing to do that now.

Basically they are trying to make you Bali ko Boka,

1. You can file for petition later by submitting that you forgot to file for your spouse and when you file at that time.......you have to pay separately for your spouse (this time might be all the fees are paying by your employer)..........next............ later while you file.............it takes 7-8 months to get approval and it is guaranteed that you will be with them for this period.

2. The best way is to file together (Sath Ziyenge Sath Marenge) ...........who knows.........later.........your case might be approve and your spouse case might get deny.
