Hello Everyone,

I was in H1 visa for a year now there was no job, I applied to change of status to F2 visa. My status is still in initial review. Meanwhile I applied for University for spring and I got admission. now  I will have to change to F1 visa. As it takes 2.5 months to get it changed I want to apply ASAP to have changed to F1.

So my questions:

Does anyone has any suggestion, what I should do, Should I sent another change of status form?
Did anyone went through same situation?

Any suggestion highly appreciated.

"I was in H1 visa for a year now there was no job"
You had a Job and that's why You were on H1B. It's your employer's duty to give U job..First and foremost File WH4 in Your State's DOL to claim the back Wages that Your Company Owes you. That would have kept u in status if u had done it earlier.

As Far as i Know, Your F2 with COS won't be approved because your are Out of Status.

You have to have F-1 Status to Study in the Univ. I highly doubt that Your F-1 Will be approved with COS even if u ask USCIS to do so.

sorry for misunderstanding but i did have job and pay stub, and i didnt get another project then i decided to go for change of status. i am sure my f2 COS will be approved in a month or so(it takes 2.5 months to complete the COS)  but the thing is I want to change to f1 before January, for that i must have at least 2.5 months.  thats why i wanted to know if anyone went through this situation?

Thanks!

Dude you said you were on H1 and you didn't have a Job(it sounded like You were on H1B all the time and you didn't had Job during all this period). If you had clearly stated the problem , then would have been a different suggestion.

Again best of Luck for your Future endeavors.
